My Health My Data Act Notice

1. INTRODUCTION.

To the extent that the Washington My Health My Data Act ("MHMD") applies to the Services, this My Health My Data Act Notice ("MHMD Notice") is provided for residents of the State of Washington in accordance with the My Health My Data Act of 2023 and sets out how AIGlowTrack collects, uses and discloses Consumer Health Data (as defined below) that we collect from you when you use our Services. This MHMD Notice supplements and is hereby incorporated into by reference our general Privacy Notice, available at www.aiglowtrack.com/privacy. Except as otherwise provided herein, all terms defined in the general Privacy Notice shall have the same meanings ascribed to them in this MHMD Notice. In the event of a conflict between the general Privacy Notice and this MHMD Notice, this MHMD Notice will prevail as to Consumer Health Data Collected under MHMD.

"Consumer Health Data" is personal information that is linked or is reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. For the purposes of this definition, physical or mental health status includes, but is not limited to:

  • Individual health conditions, treatment, diseases, or diagnosis
  • Social, psychological, behavioral, and medical interventions
  • Health-related surgeries or procedures
  • Use or purchase of prescribed medication
  • Bodily functions, vital signs, symptoms, or measurements of physical or mental health status
  • Diagnoses or diagnostic testing, treatment, or medication
  • Gender-affirming care information
  • Reproductive or sexual health information
  • Biometric data
  • Genetic data
  • Precise location information that could reasonably indicate a consumer's attempt to acquire or receive health services or supplies
  • Data that identifies a consumer seeking healthcare services
  • Any personal information that is derived or extrapolated from non-health information (such as proxy, derivative, inferred, or emergent data by any means, including algorithms or machine learning)

2. CONSUMER HEALTH DATA WE COLLECT AND PURPOSES FOR COLLECTION.

The Consumer Health Data we collect include:

  • Individual health conditions, treatment, diseases, or diagnosis
  • Social, psychological, behavioral, and medical interventions
  • Health-related surgeries or procedures
  • Use or purchase of prescribed medication
  • Bodily functions, vital signs, symptoms, or measurements of physical or mental health status
  • Diagnoses or diagnostic testing, treatment, or medication
  • Reproductive or sexual health information
  • Biometric data
  • Data that identifies a consumer seeking healthcare services
  • Any personal information that is derived or extrapolated from non-health information (such as proxy, derivative, inferred, or emergent data by any means, including algorithms or machine learning)

We collect Consumer Health Data to match and to generally provide you with Services you have requested. We may also use Consumer Health Data for essential business operations that support the provision of the Services such as analyzing our performance, tailoring the Services to you and improving our Services. Where we require your consent to collect Consumer Health Information for a specified purpose, a description of those purposes is provided to you at the time of collection. We may also use Consumer Health Data to comply with applicable legal or regulatory requirements, law enforcement requests, and to comply with and enforce our Terms and Conditions.

You can choose not to give us Consumer Health Data when we ask you for it. If you decide not to give us your Consumer Health Data, it may restrict our relationship with you. For example, we may not be able to provide you with the Services that you have requested. In addition to Consumer Health Data, we also collect and share your personal information in accordance with our Privacy Notice.

3. SOURCES OF CONSUMER HEALTH DATA.

We collect Consumer Health Data from the following categories of sources:

Directly from you when you:

  • Use our Services
  • Consent to our use of your Consumer Health Data
  • Create an Account on our Services
  • Share adverse events or medical information enquiries with us

4. THIRD PARTIES WITH WHOM WE SHARE CONSUMER HEALTH DATA.

We share your Consumer Health Data on a need-to-know basis, and to the extent necessary to follow laws and regulations, and in the context of managing our relationship with you. We will only share your Consumer Health Data with employees and specialized third party service providers who need to see it to do their jobs. All such third parties are prohibited from using your Consumer Health Data except to provide these services to AIGlowTrack and they are required to maintain the confidentiality of your Consumer Health Data.

As necessary for the purposes described above, we may share personal information, including Consumer Health Data, with following categories of third parties:

  • The Health Care Provider consulting on your medical condition
  • Service providers: vendors working on our behalf may access Consumer Health Data for the purposes described above
  • Third parties to whom we are required to disclose Consumer Health Data under applicable law, such as law enforcement agencies

5. HOW TO EXERCISE YOUR RIGHTS.

As a Washington resident, you have following rights with respect to the Consumer Health Data we process about you:

To request information about:

  • The categories or specific pieces of Consumer Health Data we have collected
  • The categories of sources from which we collected the Consumer Health Data
  • The purposes for collecting or sharing the Consumer Health Data
  • The third parties with whom we have shared or sold your Consumer Health Data

Additional Rights:

  • To request that we delete Consumer Health Data that we have collected from you
  • To withdraw your consent for us to collect, share, or sell your Consumer Health Data

To exercise your rights over your Consumer Health Data please email us at: support@aiglowtrack.com. If you choose to exercise any of these rights, AIGlowTrack will not discriminate against you in any way. If you exercise certain rights, understand that you may be unable to use or access certain features of our Services. You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof that you gave signed permission to submit the request and may also require to you to confirm with us that you provided the agent permission to submit the request or to verify your own identity directly with us.

We will take steps to verify your identity before completing your rights request. We may ask you to provide additional information, such as your name, home address, and email address. Depending on the nature of your request and our relationship with you, we may request different or additional information, including a signed declaration that you are who you claim to be.

6. CHANGES TO THIS NOTICE.

AIGlowTrack may update this MHMD Notice at any time and any changes will be effective upon posting. In the event that there are material changes to the way we treat your Personal Information, we will update the Last Modified date at the top of this Notice upon becoming effective. We may also notify you by email, in our discretion.
